Legal procedures in the field of plant protection

As the national authority for the health risk assessment for humans and animals, BfR is involved in the following procedures in the area of plant protection:

At European level (active substance procedures)

  • Approval of active substances in plant protection products
  • Definition of maximum residue levels

At national level (procedures for plant protection products)

  • Authorisation procedure for plant protection products (zonal, national and mutual recognition)
  • Approval of additional applications of authorised plant protection products
  • Listing of additives

The legal basis of these procedures is provided by Regulation (EC) No. 1107/2009, which lays down binding framework conditions for the approval and authorisation procedures for all member states, and by Regulation (EC) No. 396/2005, which governs the stipulation of maximum residue levels.

In the member states, Regulation (EC) No. 1107/2009 is implemented via national laws in which more precise stipulations are made on the national level - in Germany, this takes the form of the German Plant Protection Act (PflSchG) amended in 2012.
